TERMS OF SERVICE

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Chillbot Automation Pvt. Ltd. ("Chillbot", "we", "us"). By purchasing a beverage from a Chillbot machine, downloading the Chillbot app, or accessing our website at chillbot.in, you agree to these Terms in full.

If you are using our services on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms.

2. Services Provided

Chillbot provides:

• Automated cold beverage vending machines deployed across various locations in India.
• A mobile application (iOS and Android) for ordering, payment, and order history.
• A website (chillbot.in) for information, franchise applications, and customer support.
• A franchise partner programme for businesses wishing to deploy Chillbot machines.

We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice where practicable.

3. Ordering and Payment

All orders placed at a Chillbot machine or via the app are subject to the following conditions:

• Prices displayed are inclusive of all applicable taxes unless otherwise stated.
• Payment must be completed before the beverage is dispensed.
• Accepted payment methods include UPI, credit/debit cards, and NFC/contactless payment. Cash is not accepted.
• All transactions are processed through RBI-compliant payment gateways. Chillbot does not store your card or banking credentials.
• You will receive a digital receipt via SMS or app notification upon successful payment.

4. Refund and Cancellation Policy

Successful Orders: Orders that result in successful beverage dispensing are not eligible for refund as the product has been consumed or is available for collection.

Machine Failure: If payment is deducted but the machine fails to dispense your beverage, you are entitled to a full refund. Please report the issue within 24 hours using:

Verified refunds will be processed to the original payment method within 5–7 business days.

App Pre-orders: Pre-paid app credits are non-refundable except in the case of a machine malfunction as described above.

5. Use of Vending Machines

When using a Chillbot vending machine, you agree to:

• Use the machine only for its intended purpose of purchasing beverages.
• Not tamper with, damage, or attempt to access the internal components of the machine.
• Not attempt to obtain products without completing payment.
• Not place foreign objects, liquids, or materials into the machine.
• Comply with all location-specific rules and signage at the deployment site.

Vandalism, theft, or deliberate damage to Chillbot machines may result in criminal prosecution under the Indian Penal Code and claims for damages.

6. Chillbot App

To create a Chillbot app account, you must provide accurate registration information and be at least 13 years of age. You are responsible for maintaining the confidentiality of your account credentials.

You agree not to use the app to:

• Impersonate another person or entity.
• Attempt to gain unauthorised access to Chillbot systems.
• Engage in fraudulent transactions or abuse of loyalty/rewards programmes.

We reserve the right to suspend or terminate accounts that violate these Terms.

7. Franchise Partners

Franchise partnerships are governed by a separate Franchise Agreement signed between Chillbot and the franchise partner. These Terms of Service apply to general website and app usage. In the event of conflict between the Franchise Agreement and these Terms, the Franchise Agreement shall prevail for franchise-specific matters.

Franchise partners are responsible for ensuring that the deployment location complies with all applicable local regulations, safety standards, and food licensing requirements.

8. Intellectual Property

All content on the Chillbot website and app — including the CHILLBOT name, logo, trademarks, machine designs, software, and written content — is the exclusive property of Chillbot Automation Pvt. Ltd. and is protected under Indian intellectual property law.

You may not reproduce, distribute, modify, or create derivative works from any Chillbot content without our express written permission.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Chillbot shall not be liable for:

• Indirect, incidental, or consequential damages arising from use of our services.
• Allergic reactions or dietary sensitivities. Customers with food allergies are advised to check ingredient details before ordering.
• Machine downtime resulting from power outages, network failures, or force majeure events beyond our control.
• Loss of personal property at any Chillbot machine deployment location.

Our total liability for any claim arising from a single transaction shall not exceed the price paid for that transaction.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, India.

We encourage resolution of disputes through our customer support team before initiating formal legal proceedings.

11. Changes to Terms

Chillbot reserves the right to update these Terms of Service at any time. We will notify registered app users of material changes via in-app notification at least 14 days before the changes take effect. Your continued use of our services after the effective date constitutes acceptance of the revised Terms.
